AANH, Apartment Association of NH, is holding the annual Corn Hole tournament fundraiser on 5/14/25 Wednesday 5pm to support continuing to fund the professional lobbying firm that has been assisting our advocacy. You do not need to become a member to support the fundraiser. It is a spirited fun event including raffle prizes and an opportunity to meet some NH State Representatives and/or Senators.

HB60, Regarding Lease Expiration
Our internal intel has revealed that tenant advocates are campaigning strong against HB60 to Senators. The message they are saying is all centered around having low vacancy rates and how HB60 will exacerbate the problem, lead to more homelessness and housing providers preying on victims by jacking up rents.

We must immediately communicate to the Senators to champion for our position.

Please use the 1 Minute Advocate and communicate now on HB60 to all Senators.

In particular, if you live in or own property in the following towns your response is particularly important; please follow Special Instructions in 1 Minute Advocate:
Bedford, Fitzwilliam, Greenfield, Hinsdale, Jaffrey, Lyndeborough, Mont Vernon, New Boston, Richmond, Sharon, Temple, Troy and Winchester.

HB309, Electronic Payments Can Not Be Required.
Executive session Tuesday. If not already done, please advocate to the committee, by Monday 4/27/25, asking to eliminate the $1000/day fee.

We believe this is the first time we have a win on a lead paint bill. The committee voted along party lines to ITL (kill) the bill. We are now waiting for the full House to schedule vote on the bill which is not happening this week and likely will next week.

SB4, Title: relative to commercial property assessed clean energy and resiliency (C-PACER).

There is very large support for this bill. It appears that the bill will make it easier to use C-PACER financing which can increase the loan to value on developing real estate and aid in creating more housing. We expect this to pass quickly. It is now on the way to the governor.

Both at the committee executive session and the Full House session, it seemed Democrats could ‘see the writing on the wall’ and were scrambling to offer amendments to retain something of their position on these major bills. In the end, nothing they offered was accepted.

HB60, Lease Expiration As Eviction Ground
Property Owner Position: For
Ellen Read (democrat) presented an amendment 2025-0254h, which allowed the lease termination as grounds for eviction but only after a 6 months grace period before the 60 day notice & the record of eviction would be sealed & only in a market of >=5% vacancy.
Joseph Alexander (republican), spoke against the amendment saying it was unnecessary regulation and the bill was good as written only that if it were up to him, he would reduce the notice to 30 days.
RC Vote 140 217 amendment fails.

David Paige (democrat) presented an amendment 2025-0251h
Use of HB60 would be limited to only in market of >=2.5% vacancy
He is a mom & pop landlord, knows how difficult to evict some tenants. However, he thinks the bill will do more harm than good. He quoted Vacancy of 0.8% & 52% homelessness increase.

Joseph Alexander (republican), spoke against the amendment saying it was unnecessary regulation.

Ellen Read (democrat) PI, says 1/3 property owned by corporations, sarchastically quotes mindset that ‘anything for greed is good’. Wants to put forward amendment to put bill in a study committee.
Calvin Beaulier, (republican) PI, called it a socialist bill.

Please advocate strongly against HB724 Lead Paint Bill. Naturally at the public hearing there were many people testifying in support of the which will even further place the cost of this societal issue solely on housing providers. Howdee Everyone,

This will be a another limited legislative update. Included is a listing of the final status of the remaining 2024 bills, a sneek peek at what’s coming in 2025 & a short analysis of the change in NH legislature from the last election.
The furious roar of the start of the legislative season is just beginning. Hold on to your hats.

HB1400, Anti-Squatter Amendment attached to HB1400
We worked very diligently on this to craft language that would accomplish the goal of allowing a housing provider to quickly remove an unauthorized person while protecting rights of a true tenant and simultaneously avoid some bad unintended consequences in to versions of competing language. More on this in a future issue.

HB261, Lease Termination Domestic Violence Victims Or Newly Disabled
Property owner position: Against original bill, For Amendment 2024-0574s
We did a large amount of work on this bill and eliminated the most troublesome provisions and through some difficult talks brought it down to an acceptable version.

SB519, Restrictions On Renovation Evictions

Died on the Table.
Another win.

HB1320, Flood Insurance
Property owner position: Against original bill. Neutral on amendment 2024-1954s.
The original bill had horrible provisions for rental real estate all of which we were able to entirely remove. In the end, the bill requires that prior to the execution of a purchase and sale agreement for real property that flood risks be disclosed to the buyer.

Another bill that started out very bad and we were successful in rewriting it to something very benign.

This was a minor bill for us. It would have been good for the market to establish more incentives for housing providers.
This is not a loss for us. Rather legislators missed an opportunity.
