Update Summary
Note: some links have changed. Always use latest links in latest update.

Please make communications on the Important bills as outlined in the Action Map & 1 Minute Advocate.

Another win on Major bills:
HB724 Lead Paint Bill.

Use 1 Minute Advocate now to study and prepare communication to be delivered next week on this critically important bill..

Important Bills:
We’re still concentrating on the flood of new state level legislation. Many Important bills now have been analyzed.

We will continue analysis on these during the week. Keep checking the 1 Minute Advocate.
Meanwhile, all hearings, for Major, Important, Minor bills, are listed in the Hearing Schedule below.

See 1 Minute Advocate for Important bills.

We are preparing a new feature of the Legislative Update and will have a separate Action Map Summary for the Important bills. See the link in the Important bills section of the 1 Minute Advocate.

We have the structure of it in place. It is partially filled in. Because there are 39 Important bills, it is rather large which is why we chose to separate it from this email. Also using this method we can continue to work on an update it during the week. As we complete more analysis it will be filled in more completely. There is some, at least minimal, analysis on 27 of them so far.

SB4, Title: relative to commercial property assessed clean energy and resiliency (C-PACER).
Property Owner Position: For
There is very large support for this bill. It appears that the bill will make it easier to use C-PACER financing which can increase the loan to value on developing real estate and aid in creating more housing. We expect this to pass quickly. It is now on the way to the governor.
No action needed.

Minor Bills:

We’re still concentrating on the flood of new state level legislation. Bill Status Data for minor bills will be updated soon. We’ve started working on minimal analysis on the Minor bills as well.

Update 2025 05 ActionMap

Update Summary
Note: some links have changed. Always use latest links in latest update.
Also note that we often keep previous update info on items still active because there are often new members signing up and receiving the updates. So we want them to have the info. Please have your housing provider partners and friends join us. The more members the stronger we will be.

Analysis of the lead paint bill is completed. Pay attention to updates in 1 Minute Advocate over the next few days.

Major bills (follow action items in Action Map above):
It is critical for everyone to make communications on the Major bills as outlined in the Action Map.
Three Major bills were voted in the full House. They are all wins for us.
See Action Map and 1 Minute Advocate.

Both at the committee executive session and the Full House session, it seemed Democrats could ‘see the writing on the wall’ and were scrambling to offer amendments to retain something of their position on these major bills. In the end, nothing they offered was accepted.
(PI=Parliamentary Inquiry)
HB60, Lease Expiration As Eviction Ground
Property Owner Position: For
Ellen Read (democrat) presented an amendment 2025-0254h, which allowed the lease termination as grounds for eviction but only after a 6 months grace period before the 60 day notice & the record of eviction would be sealed & only in a market of >=5% vacancy.
Joseph Alexander (republican), spoke against the amendment saying it was unnecessary regulation and the bill was good as written only that if it were up to him, he would reduce the notice to 30 days.
RC Vote 140 217 amendment fails.

David Paige (democrat) presented an amendment 2025-0251h
Use of HB60 would be limited to only in market of >=2.5% vacancy
He is a mom & pop landlord, knows how difficult to evict some tenants. However, he thinks the bill will do more harm than good. He quoted Vacancy of 0.8% & 52% homelessness increase.

Joseph Alexander (republican), spoke against the amendment saying it was unnecessary regulation.
Sweeny RC on amendment
Vote

Karen McGaff? PI to support amendment.
Joe Alexander (republican) PI against amendment
RC Vote 145-212 amendment fails.

With amendments failed, voting proceeded with OTP HB60
David Page (democrat) against HB60
Joe Alexander, (republican) For HB60 saying it’s simple contract law.

Meryl Gibbs (democrat) PI against
Dillon Dumont (republican) PI for
2/6/25 Full House OTP RC vote 217-139, HB60 passed the House as originally written.

HB444, Tenants 60 Day Option To Buy
Property Owner Position: Against
Mathew Hicks (democrat) for the minority, requests to vote against ITL
Dick Thackston, (republican) for ITL
Mathew Hicks (democrat) PI asks to vote against ITL to allow more work on the bill and amendments
Michael Aron, (republican) for LL asks to pass as is.
2/6/25 Full House RC Vote 213-144 ITL Succeeds, bill is dead.

HB623, Entities May Not Own Real Estate
Murray (not sure which Murray) made motion to table HB623
Murray PI against the ITL wants to allow for floor amendment
Joseph Alexander. PI. Vote against motion to table to allow original ITL recommendation.
RC Vote 149, 207, motion to table fails.

Now vote on original ITL recommendation
Brian Cole, (republican) opposes HB623, says the bill is overly broad, includes LLCs & non-profits, is an unfunded mandate. Says corporations own 3% housing in US and 1.5% in NH.
Ellen Read (democrat) PI, says 1/3 property owned by corporations, sarchastically quotes mindset that ‘anything for greed is good’. Wants to put forward amendment to put bill in a study committee.
Calvin Beaulier, (republican) PI, called it a socialist bill.
2/6/25 Full House RC vote: 216 141 ITL Succeeds, bill is dead.

Please advocate strongly against HB724 Lead Paint Bill. Naturally at the public hearing there were many people testifying in support of the which will even further place the cost of this societal issue solely on housing providers. If not already done us 1 Minute Advocate and communicate to the committee now.
See Action Map & 1 Minute Advocate for details.

There are many bills listed as Important bills this season because many of them support creation of more housing. Since there are so many, we have taken them out of the Action Map and are listing them in the Important Bills section of the update and the 1 Minute Advocate.

Final outcome of the remaining 2024 bills:
Major bills (follow action items in Action Map above):

HB1400, Anti-Squatter Amendment attached to HB1400
We worked very diligently on this to craft language that would accomplish the goal of allowing a housing provider to quickly remove an unauthorized person while protecting rights of a true tenant and simultaneously avoid some bad unintended consequences in to versions of competing language. More on this in a future issue.
Signed by Governor
Another big win.

HB261, Lease Termination Domestic Violence Victims Or Newly Disabled
Property owner position: Against original bill, For Amendment 2024-0574s
We did a large amount of work on this bill and eliminated the most troublesome provisions and through some difficult talks brought it down to an acceptable version.
Signed by Governor
Another win.

Look over the new law to be sure you are compliant.

SB519, Restrictions On Renovation Evictions
Property owner position: Against
Died on the Table.
Another win.

HB1320, Flood Insurance
Property owner position: Against original bill. Neutral on amendment 2024-1954s.
The original bill had horrible provisions for rental real estate all of which we were able to entirely remove. In the end, the bill requires that prior to the execution of a purchase and sale agreement for real property that flood risks be disclosed to the buyer.
Signed by Governor
Another win.

HB283, Application Fee Limit & Refund
Property owner position: Against original bill; For amendment 2023-2441h
Another bill that started out very bad and we were successful in rewriting it to something very benign.
Signed by Governor
Another win.

This involves taking application fees. Look over the new law to be sure you are compliant.

HB379, Indigent Tenant Eviction Notice of NHLA
“Died In Interim Study”
Another win.

Important Bills:
SB392, Lead Hazard Remediation Fund
Died on the Table.
We hear that the Lead Hazard Remediation Fund was refunded another way so we still ended up with a win.

HB1281, Occupancy By Unrelated People
Died on the Table.
This was left as a You Decide bill so it is neither a win or a loss.

HB1144, Septic System Disclosure
Signed by Governor
This was left as a You Decide bill so it is neither a win or a loss.

HB1635, Short Term Rental Rooms & Meal Tax
Inexpedient To Legislate, bill died
This was left as a You Decide bill so it is neither a win or a loss.

HB1065, Limiting Sprinkler Requirements
Signed by Governor
Although not a Major bill we were For the bill so this is another win.

HB1229, Shoreline Minimum Standards Disclosure
Signed by Governor
This was left as a You Decide bill so it is neither a win or a loss.

HB1168, Study Impact Of The Housing Crisis On People With Disabilities.
Signed by Governor
This was left as a You Decide bill so it is neither a win or a loss.

HB1053, Allow Residential In Commercial Zones.
Died on the Table.
This was left as a You Decide bill so it is neither a win or a loss.

Minor Bills:
SB518, Section 8 Incentives
Property owner position: For
“Died In Interim Study”
This was a minor bill for us. It would have been good for the market to establish more incentives for housing providers.
This is not a loss for us. Rather legislators missed an opportunity.
